Derogations in Iceland due to Covid-19

Active substances and product types subject to derogation according to Article 55 in Regulation (EU) 528/2012 (BPR) 

The product types subject to derogation are human hygiene (PT 1) and surface disinfection (PT 2).

The active substance must have been evaluated and approved on EU/EEA level or notified in the review programme (EU No 1062/2014) and the notification must cover the product type in question.

Procedure
 Companies seeking to place a product on the market requiring derogation must contact the Environmental Agency of Iceland, email: ust@ust.is, and provide all relevant information on the product in question. The derogation can be applied for up to 180 days.
 Suppliers of products that contain active substances that have been approved but are not authorized in Iceland must contact the Environmental Agency of Iceland to apply for derogation.
Products that contain an active substance that is still under review, such as ethanol, can be placed on the market in Iceland during the transitional period and do not require derogation as there are no national rules applying for this situation.

Fee
 The Environmental Agency of Iceland collects a fee for applications for authorisation to place biocidal products on the market in accordance with Article 35 of the Chemicals Act No 61/2013 and Regulation (EU) No 528/2012 concerning the making available on the market and use of biocidal products. The fee for authorisation by temporary derogation (180 days) for a biocidal product is 79.200 ISK
 If the work processing an application takes more time than included in the above amounts, an extra fee may be charged. The applicant will be notified of the additional work as soon as possible. An invoice for additional work will be issued when a decision has been made regarding the authorisation of the biocidal product.
 If, on the other hand, the work is less than anticipated, the Environmental Agency can rebate the applicant for authorisation of the biocidal product. Repayment can never be higher than 80% of the fee.
